The center of the German Constitution is human dignity. Rights derive from and are interpreted through the dignity lens. On Monday our Supreme Court exhibited a deaf ear to human dignity by holding that those put in jail may be strip searched even for minor offenses like walking a dog without a leash. This is the same Supreme Court that protected those who intentionally inflict emotional distress on the grieving father as he mourned the loss of a son at his funeral. It is the same Court that prevents states from protecting the privacy of rape victims allowing a sensational press to exploit their privacy for profits.
These decisions could never happen in Germany because of its respect for human dignity. Our Supreme Court is rapidly becoming the capital of human insensitivity.
